These Terms and Conditions ("Terms") govern your purchase and use of the SnowBnB automated snow-making machine ("Product"). By purchasing our Product, you agree to these Terms in full. If you do not agree, do not purchase or use SnowBnB.

1. Product Overview and Scope

SnowBnB is an automated snow-making machine comprising two components: the base unit and the snow head. Customers are responsible for all aspects of installation, maintenance, and use.

​

2. Installation and Maintenance

• Customer Responsibility: SnowBnB does not provide installation services. Installation is the sole responsibility of the customer. We recommend using licensed electricians and plumbers for setup and provide recommendations for local professionals.

• No Guarantees for Recommendations: While we recommend licensed professionals, SnowBnB is not liable for their work or any damages caused during installation. It is the customer’s responsibility to vet and contract with installers.

• Maintenance: Routine maintenance is highly recommended twice per year to ensure optimal performance. Customers are responsible for all maintenance and upkeep.

• Initial Setup: Customers must link the Product to their booking calendar during installation to ensure proper operation. SnowBnB is not responsible for any errors in linking, calendar integration, or resulting operational failures.

3. Geographic Availability

SnowBnB is currently available only within a 200-mile radius of East Tennessee, including areas in western North Carolina, northern Georgia, and surrounding regions.

4. Payment Terms

• Payment Requirement: Full payment is required at the time of purchase. No installation, shipping, or product release will occur until payment is received in full.

• No Refunds or Exchanges: All sales are final. SnowBnB does not offer refunds, returns, or exchanges for any reason.

• Non-Disputability Clause: By agreeing to these Terms, you waive the right to dispute charges or payments related to the purchase of the Product.

5. Warranties and Disclaimers

• No Warranty: SnowBnB is sold "as-is" without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.

• Disclaimer of Performance Guarantees: SnowBnB does not guarantee specific performance outcomes, snow production volumes, or compatibility with third-party systems. All operational outcomes are at the customer’s risk.

6. Limitation of Liability

• No Liability for Damages: SnowBnB, its owners, employees, and affiliates are not liable for any damages, including but not limited to:

  • Injuries, accidents, or damages caused by snow produced by the Product, including slips, falls, or other snow-related incidents.

  • Property damage, guest dissatisfaction, or business interruptions caused by misfiring, freezing, or other malfunctions.

  • Inability to secure insurance coverage for your property due to the installation or use of the Product.

  • Losses arising from the improper installation, maintenance, or use of the Product.

• Assumption of Risk: By purchasing SnowBnB, you acknowledge that snow production inherently carries risks, including environmental, safety, and operational risks, and you accept all responsibility for these risks.

• Indemnification: You agree to indemnify and hold SnowBnB harmless from any claims, lawsuits, damages, or legal fees arising from the purchase, installation, or use of the Product.

• No Liability Post-Sale: SnowBnB bears no responsibility or liability once the Product is sold, delivered, and paid for in full.

7. Support Services

• Customer Support: SnowBnB provides 24/7 customer support for inquiries and troubleshooting. However, we require up to 48 hours to respond to all support requests.

• No Notifications: SnowBnB does not provide notifications or reminders for maintenance, updates, or troubleshooting.

8. Intellectual Property

All intellectual property rights in the Product, branding, and materials remain the exclusive property of SnowBnB. Unauthorized use or reproduction is prohibited.

9. Governing Law and Dispute Resolution

• Applicable Law: These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

• Dispute Resolution: Any disputes arising under these Terms shall be resolved exclusively in the courts of Tennessee. By agreeing to these Terms, you waive your right to initiate disputes in other jurisdictions.

10. Force Majeure

SnowBnB is not responsible for any delays, damages, or failures resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of God, supply chain disruptions, or unforeseen mechanical failures.

11. Insurance Disclaimer

SnowBnB makes no guarantees regarding a customer’s ability to obtain or maintain insurance coverage for their property following the installation or use of the Product. Customers are responsible for discussing their insurance needs and the Product’s implications directly with their insurance providers.

12. Safety and Compliance

• Regulatory Compliance: It is the customer’s responsibility to ensure compliance with all local, state, or federal regulations regarding snow production and the use of SnowBnB.

• Safety Measures: Customers must take all necessary precautions to ensure the safety of guests, residents, and visitors at their property. SnowBnB is not liable for any incidents resulting from the misuse or improper management of the Product.

13. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and SnowBnB and supersede any prior agreements or understandings.

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

• No Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of SnowBnB’s rights.
